Welcome to Atavra. These Terms of Use (“Terms”) govern your access to and use of the Atavra platform, website, and services (collectively, the “Service”) operated by Halfborg Software (“Company”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.


1. Description of Service

Atavra is a software-as-a-service (SaaS) platform designed for crisis communications training. The Service enables organizations to:

  • Create and manage simulated crisis scenarios (“Campaigns”)
  • Assign users to fictional roles (“Personas”) within these scenarios
  • Deliver scripted events through simulated platforms including mock social media, email, and news interfaces
  • Conduct live training exercises (“Campaign Runs”) where participants respond to simulated crisis situations
  • Review and evaluate training performance

All content generated within the Service, including simulated social media posts, news articles, emails, and other communications, is entirely fictional and created solely for training purposes.


2. Account Registration

2.1 Account Creation

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.2 Organizations

Users may create or join organizations within the Service. When you create an organization, you become its administrator and are responsible for:

  • Managing organization membership and user roles
  • Ensuring all organization members comply with these Terms
  • Content created within your organization’s campaigns

2.3 Age Requirements

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.


3. Subscription and Payment

3.1 Fees

Access to certain features of the Service requires a paid subscription. Subscription fees, billing cycles, and payment terms are as specified at the time of purchase or in your subscription agreement.

3.2 Billing

You authorize us to charge the payment method on file for all applicable fees. Fees are non-refundable except as expressly stated in these Terms or required by applicable law.

3.3 Changes to Pricing

We reserve the right to modify our pricing at any time. Changes to subscription fees will take effect at the start of your next billing cycle following notice of the change.


4. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and complete information when creating accounts, organizations, campaigns, and content
  • Use the Service only for lawful purposes and in accordance with these Terms
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access to your account
  • Ensure that any users you invite to your organization understand and comply with these Terms

5. Acceptable Use Policy

5.1 Permitted Use

The Service is intended for legitimate crisis communications training, education, and professional development purposes.

5.2 Prohibited Activities

You may not:

  • Use the Service to create, distribute, or publish content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Represent simulated content created within the Service as real events, news, or communications
  • Use simulated content to deceive, defraud, or mislead any person or entity outside of authorized training exercises
  • Impersonate real individuals, organizations, or entities in a manner intended to deceive
  • Use the Service to harass, bully, or intimidate any person
  • Attempt to gain unauthorized access to the Service, other user accounts, or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service for any commercial purpose other than as expressly permitted
  • Resell, sublicense, or transfer your access to the Service without our written consent

5.3 Content Guidelines

When creating campaign content, personas, and scenarios, you must:

  • Ensure content is appropriate for professional training environments
  • Not include content that promotes violence, discrimination, or illegal activities beyond what is necessary for realistic crisis simulation
  • Clearly mark all training exercises as simulations to participants
  • Not use the likeness, name, or identity of real persons without appropriate authorization

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by Halfborg Software and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6.2 Your Content

You retain ownership of content you create using the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving the Service.

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without restriction or compensation to you.


7. Simulated Content Disclaimer

Important: All content displayed within the Service’s simulated platforms—including but not limited to mock social media posts, news articles, emails, and other communications—is entirely fictional and created for training purposes only.

  • Simulated content does not represent real events, persons, organizations, or statements
  • Any resemblance to real events, persons, or organizations is coincidental unless explicitly designed for authorized training purposes
  • Users must not screenshot, share, or otherwise distribute simulated content in a manner that could be mistaken for real content
  • The Company is not responsible for any misuse of simulated content by users

8. Third-Party Services

The Service may integrate with or contain links to third-party services, including authentication providers and cloud infrastructure. We do not control and are not responsible for the content, privacy policies, or practices of third-party services. Your use of such services is at your own risk and subject to the terms and conditions of those services.


9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of information as described in the Privacy Policy.


10. Disclaimers

10.1 “As Is” Provision

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee of Outcomes

We do not guarantee that the Service will meet your specific training objectives or produce particular outcomes. The effectiveness of crisis communications training depends on numerous factors beyond our control.

10.3 Service Availability

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue the Service at any time without notice.


11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • IN NO EVENT SHALL HALFBORG SOFTWARE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
  • OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
  • THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.


12. Indemnification

You agree to indemnify, defend, and hold harmless Halfborg Software and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • User Content you create or submit
  • Any misrepresentation of simulated content as real

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the Service. Upon termination, your right to use the Service will immediately cease.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, breach of these Terms or conduct that we determine to be harmful to other users or our business interests.

13.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your account and any associated data, although we may retain certain information as required by law or for legitimate business purposes.


14. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Service prior to the changes taking effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms.


15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved in the courts of Singapore, and you consent to the exclusive jurisdiction of such courts.


16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Halfborg Software regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
